1. Agreement to Terms

By accessing or using SideHustleBuilder.com ("the Site") or purchasing any services offered by SideHustleBuilder ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Site or purchase our services.

SideHustleBuilder is a brand of GIG Media and Consulting. These terms govern the website design and hosting services we provide to individual clients ("you" or "Client").

2. Services

SideHustleBuilder provides done-for-you website design and hosting services for side hustlers and small business owners. Our services include:

• Website design and build using our pre-designed templates
• Content implementation based on your submitted intake form
• Domain connection and configuration
• Ongoing website hosting and maintenance
• Brand naming services (where purchased)

All services are delivered as described on our website at the time of purchase. We reserve the right to modify or discontinue services with reasonable notice.

3. Payment and Pricing

Website Launch Package: Payment is due in full at the time of purchase, or per the agreed payment plan schedule. Early Adopter pricing is locked in at the rate available at the time of purchase and will not increase for the life of your account, provided your hosting subscription remains active.

Monthly Hosting: Hosting fees are billed monthly beginning after your site goes live. Your Early Adopter hosting rate is locked for life as long as your subscription remains active without interruption. Cancellation and reactivation may result in the current standard rate applying.

Payment Plans: If you select a payment plan, you authorize us to charge your payment method on the agreed schedule. Failure to complete payment may result in suspension of services.

All payments are processed securely through Stripe. We do not store your payment information.

4. Refund Policy

Website Launch Package: Due to the custom nature of our work, all sales are final once the build process has begun (defined as receipt of your completed intake form). If you have paid and not yet submitted your intake form, you may request a full refund within 7 days of purchase.

Monthly Hosting: Hosting fees are non-refundable. You may cancel at any time; your site will remain active through the end of the billing period.

To request a refund where eligible, contact us at support@sidehustlebuilder.com within the applicable window.

5. Deliverables and Timelines

We aim to deliver your completed website within 48 hours of receiving your completed intake form. This timeline is our standard target and not a guaranteed contractual deadline. Delays may occur due to incomplete or unclear intake submissions, high volume, or circumstances outside our control.

You will receive a preview link for review before your site goes live. You are entitled to one round of revisions included with your purchase. Additional revision requests may be subject to additional fees.

6. Your Content and Responsibilities

You are solely responsible for all content you submit through our intake form, including text, images, business information, and any other materials. By submitting content to us, you represent and warrant that:

• You own or have the right to use all submitted content
• Your content does not infringe on any third-party intellectual property rights
• Your content is accurate and not misleading
• Your business and its operations comply with applicable laws

We reserve the right to refuse to build or host websites for businesses or content that we determine, in our sole discretion, to be illegal, harmful, deceptive, or contrary to our values.

7. Intellectual Property

Your content: You retain full ownership of all content you provide to us.

Our templates and code: The underlying templates, code, and design frameworks used to build your site are and remain the intellectual property of SideHustleBuilder / GIG Media and Consulting. Your license to use them is contingent on an active hosting subscription.

Your completed site: Upon full payment and while your hosting subscription is active, you have a non-exclusive license to use your completed website for your business purposes.

8. Hosting, Uptime, and Domain Management

We make reasonable efforts to maintain your website's availability and performance. However, we do not guarantee 100% uptime. Scheduled maintenance, server issues, or events beyond our control may result in temporary downtime. We are not liable for losses resulting from website downtime.

Hosting includes management of your domain, server, security updates, and basic maintenance. Significant content changes outside of the original build may be subject to additional fees.

Domain Management: Your domain is registered with you as the legal registrant. SideHustleBuilder manages the domain on your behalf for the duration of your hosting subscription, including DNS configuration, renewal coordination, and technical settings. You retain full legal ownership of your domain at all times. Domain renewal costs are included in your monthly hosting fee. Upon cancellation of your hosting subscription, you have 30 days to request a domain transfer to a registrar of your choice. We will initiate the transfer within 5 business days of your request at no additional charge. If no transfer is requested within 30 days of cancellation, the domain will be released and may become available for public registration.

9. Change Requests

Your website build includes one round of revisions as described in Section 2. After your site goes live, change requests may be submitted through the client portal or by contacting support@sidehustlebuilder.com.

We aim to complete standard change requests (text updates, image swaps, minor layout adjustments) within 5 business days of receipt. Complex changes, new sections, or significant redesigns may require additional time and may be subject to additional fees. We will communicate any additional costs before proceeding.

Change request turnaround times are targets, not guaranteed deadlines. Delays may occur during high-volume periods or due to incomplete information provided by the client.

10. No Business Results Guarantee

SideHustleBuilder provides website design and hosting services. We do not guarantee any specific business outcomes, including but not limited to increased traffic, leads, sales, revenue, search engine rankings, or client acquisition as a result of our services.

The success of your business depends on many factors outside our control, including the quality of your product or service, your marketing efforts, your industry, and market conditions. A professionally built website is a tool -- results depend on how you use it.

11. Cancellation

You may cancel your hosting subscription at any time by contacting us at support@sidehustlebuilder.com. Upon cancellation, your site will remain active through the end of your current billing period, after which it will be taken offline.

Upon cancellation, you have 30 days to request a transfer of your domain and/or your site files. We will provide your site files and initiate your domain transfer within 5 business days of your request at no charge. See Section 8 for full domain transfer terms.

12. Limitation of Liability

To the maximum extent permitted by law, SideHustleBuilder and GIG Media and Consulting shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of our services.

Our total liability to you for any claim arising out of or related to these terms or our services shall not exceed the total amount you have paid us in the 12 months preceding the claim.

13. Disclaimer of Warranties

Our services are provided "as is" without warranties of any kind, express or implied. We do not warrant that our services will meet your specific business objectives, generate revenue, or produce any particular result for your business.

14. Governing Law

These Terms of Service are governed by the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in New York.

15. Changes to These Terms

We reserve the right to modify these Terms of Service at any time. We will notify active clients of material changes via email. Your continued use of our services after any changes constitutes your acceptance of the updated terms.
