These are the terms for using SideHustleBuilder. Written to be read, not skimmed past. When you check out, you agree to them.
SideHustleBuilder.com is operated by GIG Media and Consulting LLC ("we," "us"), based in New York. You can reach us any time at hello@sidehustlebuilder.com. In these terms, "you" means the person or business buying the service.
One flat $150 build fee gets your website designed and built from the design you choose and the words you provide. Hosting keeps it live: $30 a month billed annually ($360 charged once at signup), or $40 a month billed monthly. If pricing ever changes for new clients, your rate never does...you keep the rate you signed up at, for as long as your hosting stays active without a break. Prices are in US dollars and don't include any taxes that may apply.
You provide the words, photos, and business details for your site. You confirm that you own them or have permission to use them, that they're accurate, and that they don't infringe anyone's rights or break any law. Content that's illegal, infringing, or misleading doesn't get built, and we may decline or remove it.
Your content stays yours. So that we can actually build and host your site, you give us permission to store, copy, adapt, and publish that content for that purpose, and to show your finished site as an example of our work unless you tell us in writing not to. That permission ends when your hosting ends, except for copies kept in routine backups.
You confirm you're at least 18 and able to enter into this agreement.
Your site goes live within 48 hours of you submitting your completed content. The clock starts when you hit submit, not at checkout, and it pauses if what you submitted is incomplete or if something outside our control gets in the way, like an outage at one of the services we rely on.
Your site comes with a self-serve editor. Content changes are unlimited and free...you make them yourself, anytime.
If your site fails to build correctly and the cause is ours rather than something in what you submitted, tell us within 30 days of delivery. We'll fix it, or refund your $150 build fee and close your account, whichever we determine is appropriate. That is the only remedy we offer for a failed build, and it's capped at the build fee.
Your hosting renews automatically until you cancel it. Annual plans renew once a year on your signup date and are charged $360 to the card on file. Monthly plans renew every month and are charged $40 to the card on file.
You can cancel at any time from your billing portal, in one click, with no call and no email required. Cancelling stops the next charge. It takes effect at the end of the period you have already paid for.
We email you a reminder before every annual renewal, and before any renewal where the price has changed.
Monthly hosting can be switched to annual anytime (the full $360 is charged at switch and your renewal date resets to that day). Annual does not switch back to monthly.
If a payment fails, we'll try again and let you know. If it's still unpaid after 10 days, we may take your site offline until the balance clears. Your files are kept for 30 days from the day the site goes offline.
Your site launches on a hosted subdomain, live and shareable from day one. A custom domain can be connected at any point after launch. Domains you register yourself belong to you; transferring a domain out is free and client-initiated.
If we register a domain on your behalf, we charge our cost from the registrar plus a set markup. The exact price is shown to you before you confirm, and the renewal price is shown to you again ahead of each renewal, because registrars change their pricing. It's charged to the card on file, and only if we're able to get the domain for you. Once a domain is registered it can't be refunded, because the registrar charges us for the full registration term the moment it goes through. That's true anywhere you buy a domain, not just here. It's registered in your name, not ours...you're the legal owner on record from day one. We're just the account it's parked in for billing and renewal, the same way a phone carrier holds your line while you're paying it off. That doesn't make the phone theirs, and it doesn't make your domain ours. Want to move it somewhere else later? That's free, anytime, your call. We hand over what you need and step out of the way.
We're responsible for building your site as designed and keeping it hosted while your hosting is active. We're not responsible for your business results...your hustle is yours. We also don't control whether your site meets any legal requirements that apply to your particular business, including accessibility, licensing, and advertising rules. That part is on you.
The service is provided as is and as available. To the fullest extent the law allows, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the service will be uninterrupted, error free, secure, or free of harmful components, or that your site will rank, perform, or convert in any particular way. We depend on third party providers for hosting, payments, email, and domain registration, and we are not responsible for their outages or failures.
To the fullest extent the law allows, our total liability to you for any and all claims is limited to the amount you paid us in the twelve months before the claim arose.
We are not liable for lost profits, lost revenue, lost business, lost data, loss of goodwill, or any indirect, incidental, special, consequential, exemplary, or punitive damages, even if we were told those were possible and even if a remedy fails of its essential purpose.
Some states do not allow some of these exclusions. Where that's the case, this section applies as far as that state allows and no further, and nothing here limits liability that cannot be limited by law, including for fraud.
If something you send us, words, photos, or claims about your business, leads to a claim against us, you agree to defend us and cover the resulting losses, damages, and reasonable legal fees. We'll tell you promptly about any such claim and let you control the defense, as long as you don't settle in a way that puts an obligation on us without our agreement.
We may suspend or end your service if you don't pay, if you use the service to break the law or infringe someone's rights, if you abuse our systems or our people, or if you materially break these terms and don't fix it within 10 days of us asking. Where the situation allows for it, we'll warn you first. If we end your service for one of these reasons, you can still get your files under the 30 day export above, and hosting fees already paid are not refunded.
If you believe content on a site we host infringes your copyright, email hello@sidehustlebuilder.com with the work involved, where to find the material, your contact information, and a statement that you believe in good faith the use is unauthorized and that your notice is accurate. We remove or disable infringing material when properly notified, and we end service for clients who repeatedly infringe.
If these terms change, we'll update this page and the date at the top. For changes that materially affect your rights, we'll email you at least 30 days before they take effect. Continued use of your hosting after that means you accept the updated terms. If you'd rather not, cancel before they take effect.
These terms are governed by the laws of the State of New York, without regard to its conflict of law rules. Any dispute arising out of or relating to these terms or the service goes exclusively to the state or federal courts located in New York County, New York, and you and we both consent to those courts hearing it. To the fullest extent the law allows, you and we each waive the right to a jury trial. Nothing here takes away any right you have to bring a claim in your local small claims court, or any protection your home state's consumer laws give you that can't be waived.
